Moray Council reviews outdoor seating permissions for local businesses

17 June 2025 • Sarah Medcraf

Moray Council has published a review of its process for allowing cafes, restaurants, and pubs to place tables, chairs, and other items on public footpaths.

Since changes to national planning rules in March 2023, businesses no longer need planning permission for outdoor dining. However, they must still get consent from the council's roads authority to ensure pavements remain safe and accessible for everyone.

Many businesses already have approval from before the rule changes and do not need to reapply.

Cllr Marc Macrae, Chair of Moray Council’s Economic Development and Infrastructure Services Committee, said: “Outdoor dining adds vibrancy to our town centres and supports local businesses, but it’s important that it’s done safely. We encourage more businesses to take advantage of the opportunity to extend their hospitality outdoors while keeping our footpaths clear and accessible.”

Applying is straightforward and helps ensure public spaces remain welcoming for all, including those with mobility needs.

Guidance and applications are available on Moray Council's website.
